Hybrid Air Vehicles Ltd (“HAV”, “HAV Ltd” or the “Company”) is committed to protecting the privacy of individuals who visit the Company's Web sites (“Visitors”), our investors (“Shareholders”), individuals who join our Airlander Club (“Airlander Club Members”), individuals who apply to join our business (“Prospective Employees, Prospective Consultants and Prospective Contractors”), existing and prospective customers, press and media and suppliers.

This Privacy Notice describes HAV's privacy practices in relation to the above groups.

HAV’s Privacy Policy covers its use of Employee, Consultant and Contractor personal data and is available to all HAV’s employees, consultants and contractors.

In relation to each group, this Privacy Notice explains the following:

Web Sites Covered

This Privacy Notice covers the information practices of Web sites that link to this Privacy Notice, including: https://www.hybridairvehicles.com, https://www.airlander.co.uk and other Web sites under the hybridairvehicles.com domain which are owned and operated by the Company.

HAV’s Web sites contain links to other external Web sites, for instance to our content on social media platforms like Facebook, Twitter, YouTube and LinkedIn, to other news channels and to Web site homepages of our channel partners, sponsors and key supply chain members. The privacy statements of these other Web sites govern the information practices or the content of these other Web sites. The Company encourages you to review the privacy statements of other Web sites to understand their information practices.

Our Web site includes social media features, such as the Facebook 'Like' button and widgets, such as the 'Share this' button or interactive mini-programs that run on our Web site. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Web site. Your interactions with these features are governed by the privacy statement of the company providing it.

Shareholder contact information, such as name, company name, title, email address, mailing address and potentially phone number.

To meet the statutory requirements upon the company including, but not limited to, the provisions set out in the Companies Act 2006. This includes maintaining a register of members, distributing statutory accounts and providing notice of meetings of the members.

The company also uses shareholders contact details to provide periodic updates on the progress of the company and other such matters deemed to be of interest, including, where possible, funding rounds.

The companies share register is held and maintained by Computershare Limited. Computershare act as a Data Processor on behalf of HAV.

Shareholder information is shared with Companies House, as and when required, HM Revenue and Customs, the company’s auditors and, under the protection of a non-disclosure agreement, for the purposes of financial due diligence and the like.

Legal Obligation

Shareholder information will be held for 7 financial years after the financial year in which an individual ceases to be a shareholder. This is so that the company can meet its obligation under the Companies Act 2006 and UK Tax law.

Airlander Club contact information, such as name, company name, title, email address, mailing address and phone number. In addition some other information is optionally provided.

To send Airlander Club members information related to Airlander Club (news updates, regular newsletters, details of Airlander Club activities or promotions).

To contact Airlander Club members by phone in the event of any issues preventing communication by email.

With our service provider for Airlander Club merchandise (Currently RBLI Ltd) for the purpose of providing new member merchandise offered as part of the Airlander Club joining package.

With our emailing service provider (Currently Mailchimp) for the purpose of distributing Airlander Club newsletters and other Airlander-related mailings to the Airlander Club.

Contractual requirement

Airlander Club contains two categories of member: Founder/Lifetime Members and Annual Members. For Founder Members, their data will be held until the 3 months after the company is notified of their bereavement. For Annual Members, their details will be held for 6 months after their membership lapses. This is so as to allow time for a temporarily lapsed member to re-join the Club.

If Airlander Club Founder Members (or other Airlander Club members) wish to leave the Airlander Club or cease receiving mailings they should unsubscribe using the link at the bottom of each mailing, or email privacy@hybridairvehicles.net with a request to be removed from the Airlander Club.

 

 

Prospective Employees, Prospective workers, Prospective volunteers, Prospective interns, Prospective apprentices, Prospective Consultants and Prospective Contractors names, contact details and employment details if you send us a CV, resumé or other details of your employment history, qualifications and experience in connection with an advertised job vacancy or a general inquiry regarding employment opportunities with us. These may be provided by 3rd party recruitment agents who you have asked to act on your behalf or to whom you have submitted these details.

To assess your application and communicate with you about the position.

With our online recruitment service provider (Currently EasyWeb Group), employment referees and our background check service providers including HM Government agencies where security clearance checks are required.

We keep information on unsuccessful applicants located in the EU for 12 months in case another relevant position arises.

Prospective customer contact information, such as name, company name, title, email address, mailing address and phone number.

To develop awareness about the Airlander products and applicability to customer’s needs.

Prospective customer’s data may be shared with certain associated organisations of the company, including its advisors. Where the interaction between the company and the prospective customer is confidential, information will only be shared under the protection of a non-disclosure agreement.

Legitimate interest in securing customers for the company’s products and services.

The company will hold information on prospective customers for a period of 5 years from when discussions cease. This period is deemed reasonable given the long sales cycle of the industry.

Customers contact information, such as name, company name, title, email address, mailing address and phone number.

To deliver Airlander products and support services to meet customer’s needs.

Customer’s data may be shared with certain associated organisations of the company, including its advisors. Where the interaction between the company and the customer is confidential, information will only be shared under the protection of a non-disclosure agreement.

Legitimate interest delivering contracted products or services for customers

The company will hold information on customers for a period of 5 years from when contracts complete. This period is deemed reasonable given the long sales cycle of the industry.

Press and media contact information, such as name, company name, title, email address, mailing address and phone number.

So as to communicate with relevant press and media organisations about the developments and advancements of the company and its products.

Press and media contact information will be shared within HAV, with its employees, contractors and consultants.

Details will also be shared with our emailing service provider (Currently Mailchimp) for the purpose of distributing mailings.

Legitimate interest in promoting the company, its brand and products through the mainstream media.

The company will hold press and media contact information until 6 months after notification that an individual has ceased to be employed in the sector. This is in case the individual decides to recommence employment in the sector.

Company’s suppliers, advisors, regulatory authorities and other organisations and bodies necessary for HAV to support its business operations. The information held typically includes name, company name, title, email address, mailing address and phone number.

So as to facilitate the day to day operation of the business.

The company may share information with other organisations and bodies necessary for HAV to support the day to day operation of its business as the nature of the company’s activities necessitates a collaborative work approach across a wide group of parties. The company will be mindful to only share information where it is required to facilitate the task at hand and with the agreement of the relevant parties.

Legitimate interest in the day to day operations of the company

The company will retain the data associated with projects until the project data is archived, as this is likely to be part of design/procurement traceability of decision making etc.

Web browsing Information from your Web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, internet service provider (ISP), operating system, date/time stamp, and clickstream data and the actions you take on the Company's Web sites (such as the web pages viewed, the links clicked and the information submitted)

We use this information for what is usually called "analytics" — essentially to understand how Visitors move around our Web sites, what content is popular and what is not – and (either alone or with information about the company you work for) to provide more personalized information about us. We hold this information against a Visitor’s IP address, unless a Visitor submits contact information to us, in which case we hold this information against the submitted contact information. We use this information to help improve our Web sites.

Usage data is collected on our behalf and analysed by third party analytics providers (Google Analytics) on our behalf.

This data is available to and may reside on the servers of our Web Services provider (Currently Verto) who provide recommendations on and updates to our web sites.

Legitimate Interests in monitoring and improving our Web sites

We keep usage data for analytics and product improvement purposes indefinitely because historical usage data is always relevant to the development of our technology. Please consult the policies of our third party analytics and tracking providers in our Cookies and other Tracking Technologies section or their retention and erasure policies.

Web or social media content you upload

If you choose to contribute to any of our website forums or discussions, or to our Social Media feeds, we may make what you upload available to other website or forum visitors, discussion participants, or to other social media feeds.

If you email, phone or mail us questions relating to our business or our activities we may ask to share these and our responses with other stakeholders such as other Airlander Club members. We will ask for your permission before doing this or share it on an anonymised basis.

With our hosting provider (currently Verto), other social media hosting platforms (such as Facebook, Instagram, Twitter and other similar platforms) and with other members of forums or discussion threads on our website. With other Airlander Club members.

Legitimate Interests in encouraging the sharing of knowledge, news, ideas and experiences related to the Airlander platform.

We retain your community forum-posted, website-based and/or shared social media content until withdrawn at your request (or where we are legally required to remove or otherwise choose to remove the content).

Accessing, Correcting, Erasing or Porting Personal Data

HAV acknowledges that all individuals have the right to access their personal information and to request correction, erasure, rectification and data portability. An individual who seeks access to or who seeks to correct, amend, or delete inaccurate data which HAV holds should direct his/her query to privacy@hybridairvehicles.net. If an individual requests that we remove personal data on their behalf, we will respond to their request within one month.

Security

The security of individual’s personal data is important to us. HAV uses robust security measures to protect personal information from unauthorized access, maintain data accuracy, and help ensure the appropriate use of personal information. HAV hosts personal information in a secure server environment that uses firewalls, intrusion detection systems, and other advanced technology designed to prevent interference or access from outside intruders. Access to personal information is limited by access control and by password/encryption to HAV employees, contractors or consultants who need access to that data in order to perform the activities listed above. No method of transmission over the Internet, or method of electronic storage, however, is 100% secure. Therefore, we cannot guarantee or warrant its absolute security. Marketing Opt-Out

If at any time after consenting to our sending you communications, you change your mind about receiving information from us, please send us a request specifying your new choice. Simply send your request to privacy@hybridairvehicles.net. HAV will respond to your request within at most one month from the date of your request.

We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements and will only contact you in relation to these items.

Cookies and other Tracking Technologies

HAV and its web services provider (currently Verto) use cookies and other tracking technologies such as beacons, tags and scripts, to make interactions with the Company’s Web sites easy and meaningful. When you visit one of the Company's Web sites, HAV’s (or one of our third parties service provider’s) servers send a cookie to your computer. Cookies are pieces of information that a Web site transfers to your hard drive to store and sometimes track information about you. Most Web browsers automatically accept cookies, but if you prefer, you can change your browser settings to prevent that and your help screen or manual will tell you how to do this. They disappear from your computer when you close your browser software or turn off your computer. We use session cookies to make it easier for you to navigate our Web site. Web Beacons

We may employ a software technology called clear gifs (a.k.a. Web Beacons), that help us better manage content on our site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user's computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to our Visitors’ personal data.

Sharing of Information Collected

We will share your personal data with third parties in the ways that are described in this Privacy Notice. We do not sell your personal data to third parties.

Service Providers

HAV may share personal data about Visitors and Attendees with the Company's contracted service providers so that these service providers can provide services on our behalf, such as administering email services. HAV may also share your personal data with the Company's service providers to ensure the quality of information provided. These companies are authorised to use your personal data only as necessary to provide these services to us.

Compelled Disclosure

HAV reserves the right to use or disclose information provided if required by law or if the Company reasonably believes that use or disclosure is necessary to protect the Company's rights, protect your safety or the safety of others, investigate fraud and/or to comply with a judicial proceeding, court order, legal process or other governmental authority; provided, however, that unless prohibited by law, HAV will use its reasonable efforts to give you notice to enable you to seek a protective order or take other appropriate action.

Acquisitions

As HAV continues to develop its business, it may sell or purchase assets or undergo corporate reorganizations such as mergers. If another entity acquires HAV or all or substantially all of HAV’s assets, Customer Data and any other information that HAV has collected about Customers will be transferred to such entity as one of the transferred assets. You will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of your personal data, as well as any choices you may have regarding your personal data.
